Terms of service

Quotes and contracts

A message on the website is an enquiry, not a contract. Work starts when both sides agree a written scope, price, and timeline, and when any stated advance is received. WhatsApp confirmation can count as writing if it names the scope and the amount.

Your materials

You must have the right to give us logos, photos, copy and data. You keep ownership of those files. You grant us a licence to use them to deliver the project. If a third party claims those files, you cover the claim.

Our work product

After full payment, you own the unique design and code we made for you, except third party themes, plugins, stock photos, fonts and open source libraries which stay under their own licences. The Digitaal theme files used as a base remain third party licensed software. We cannot transfer a licence we do not own.

Timelines

Dates slip if feedback, content or access is late. Hosting, domain, Google and Meta accounts must be in your name unless we agree otherwise. Ads spend and third party fees are extra and are paid to those vendors.

No ranking or lead promise

SEO, ads and social work can improve visibility. We do not guarantee a Google rank, a number of leads, or a sales figure. Auction prices and competitor activity change.

Acceptable use

We may refuse work that is illegal, misleading, or that asks us to post fake reviews or hidden text. You must not attack the site, scrape it in bulk, or use our name to imply a partnership we did not agree.

Liability

To the extent Indian law allows, our liability for a project is capped at the fees you paid us for that project in the previous three months. We are not liable for lost profits, lost data on your side, or third party outages (host, Google, Meta, WhatsApp, payment gateways).

Law

These terms follow the laws of India. Courts at Ghaziabad, Uttar Pradesh have jurisdiction, unless a separate signed contract says otherwise.
